Welcome to Rose and Samite Boutique! By accessing this website, you agree to be bound by these terms and conditions, which together with our Privacy Policy and Disclaimer govern Rose and Samite Boutique's relationship with you in connection to this website. For the purposes of these Terms, “Client”, “You”, and “Your” refer to you, the person accessing this website and accepting our terms and conditions. “The Company”, “Ourselves”, “We”, and “Us” refer to Rose and Samite Boutique. “Party” or “Parties” refers to both the Client and ourselves, or either the Client or ourselves.

Sales Contract

When you place an order on www.roseandsamite.com (the “Website”) for products offered by us, you make an offer to conclude a sales contract. A sales contract is only formed upon our confirmation of your order by email.

To place an order, you must be at least 18 years old or have permission from the bill payer. This contract is between you and Rose and Samite Boutique; no third party has rights to enforce any of its terms, and no third-party consent is required to end or amend the contract.
 

Order Placement

Once you place an order, you will receive an email acknowledgment that we have received it. This acknowledgment does not mean your order has been accepted. We will confirm acceptance via email by providing an invoice that includes shipping costs. After payment has cleared, we will dispatch your order.

Payment

Please complete your payment via bank transfer, using the bank details provided on the invoice.

Pricing and VAT

All prices displayed on our website are subject to the current rate of VAT applicable in the UK. If the VAT rate changes between your order date and delivery date, we will adjust the VAT unless full payment was already received before the change.

In case of a pricing error that is evident and could have been reasonably identified by an average customer, we reserve the right to cancel the order, refund any payments made, and request the return of any goods provided.

Delivery

We deliver to the address provided at the time of order placement. It is your responsibility to ensure the accuracy of the address. We are not liable for delays or missing items due to third-party issues. If a delivery goes missing due to the fault of a courier, we will provide a like-for-like replacement after a reasonable investigation period and your assistance in any subsequent investigations. 

Please note, we do not deliver to PO Boxes within the UK.

Warranty

Our warranty is valid only for the original purchaser of the item and applies only to new products purchased directly from Rose and Samite Boutique. Any attempt to repair or modify the item by a third party invalidates the warranty.

For disputes regarding product defects, we may, at our discretion, engage an independent third-party assessor to determine if a defect exists. If the defect is confirmed as a fault in materials or craftsmanship, we will repair the item.

Warranty claims must be made within 14 days of purchase. Please retain proof of purchase documents as these are required for warranty claims.

Limitation of Liability

By using this Website, you agree to indemnify Rose and Samite Boutique against any liabilities, expenses (including legal fees), and damages arising from claims related to your use of this Website. Subject to any required indemnities, in no event shall either party’s liability exceed the total amount paid under a confirmed order.

We will not be liable for any:
     .Loss of profits, business opportunity, or goodwill
     . Data loss or anticipated savings
     . Special, indirect, or consequential losses arising under or related to these terms.

Our liability exclusions and limitations are in line with each party’s commercial risk capacity and are deemed reasonable.

Nothing in these terms limits or excludes liability for fraud, fraudulent misrepresentation, or breaches of the Consumer Rights Act 2015.
 

Force Majeure

Rose and Samite Boutique will not be held responsible for delays or failures in performance due to circumstances beyond our control, including but not limited to industrial actions, civil unrest, natural disasters, transport or communication disruptions, or government restrictions.

Should a Force Majeure event occur, we will suspend performance for the duration of the event and will use reasonable efforts to fulfill our obligations as soon as the event concludes.
